Deviating, conflicting or supplementary general terms and conditions of the user do not become part of the contract unless their validity is expressly agreed to.
MyOfficePilot is a native app for iPhone, iPad and Mac for managing emails, calendar events and tasks. The app includes in particular the following functions:
The app works locally on your device. Synchronisation between your devices – if you use it – takes place via your own iCloud. The provider does not operate any server of its own for storing your content. The provider reserves the right to further develop the range of functions, provided this is reasonable for the user and the basic character of the app is preserved.
The app is downloaded and installed via the Apple App Store. Apple’s terms of use additionally apply to obtaining the app via the App Store. The provider is not a contracting party to the App Store purchase.
By downloading and using the app, a usage agreement for the provision of the app’s functions under these terms is concluded between you and the provider. Registration with the provider is not required.
Use of MyOfficePilot is currently free of charge. The user incurs no fees or hidden costs on the part of the provider. Any costs charged by your mobile/internet provider for data transfer are borne by you.
The provider reserves the right to introduce paid additional features in the future. Paid use takes place only after prior information and the express consent of the user.
To use the app you need:
The user warrants that they are authorised to use the email accounts they connect.
The user is responsible for keeping their credentials confidential. The user undertakes not to use the app in an abusive or unlawful manner, in particular not to send or store unlawful content.
Since the core functions of the app run locally on your device, availability is largely independent of any infrastructure of the provider. The provider gives no guarantee for the availability of third-party services (Apple App Store, iCloud, email providers, Microsoft, Google). As the app is provided free of charge, there is no entitlement to any particular availability or further development.
At your request, MyOfficePilot establishes connections to external services, in particular to your email providers (IMAP/SMTP), to Apple iCloud and to Microsoft or Google (OAuth). The provider assumes no liability for:
The provider is liable without limitation for damage resulting from injury to life, body or health and for damage caused by intent or gross negligence.
As the app is provided free of charge, the provider is liable for other damage only in cases of intent and gross negligence. Liability for slight negligence is excluded unless it concerns the breach of essential contractual obligations (cardinal obligations); in that case liability is limited to the typically foreseeable damage.
As the app works locally on your device, it is recommended that you make your own regular backups of important data.
Information on the processing of personal data can be found in our Privacy Policy.
The provider reserves the right to amend these terms with a reasonable notice period (at least 30 days). Users will be informed of material changes. If the user does not object to the amended terms within the period set, the new terms are deemed accepted. The right to object and its consequences will be pointed out separately in the notice.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the provider’s registered office. For consumers, the statutory rules on jurisdiction apply.
Note on EU dispute resolution: the European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. The provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Should individual provisions of these terms be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory rule.
